    Dreamhost are pretty resiliant against take-down requests. They tend to host a lot of the asshole neo-nazi sites and shit which are lawsuit magnets and they dont seem to budge.

    Alternatively if you don’t want to give your money to fascism collaborationists, I’ve found Rackhost to be pretty pro-customer and takedown resistant.

    Would they be pleased if it was simply removed? Most cases like this begin with a cease and desist.

    Aside that, there are many Michael Jacksons in the world and the title “King of Pop” isn’t an official title, so much as I know. The strip could be about anyone. Yeah… go with that. I once served as my own lawyer in court and won, so my record stands for itself.

    While I can understand why this strip would upset some people, it’s still hilarious! I wish you the best with all the legal work ahead of you and hope that it’s eventually decided to leave the site up.

    I came across my original copy of this strip a little while back. When originally published it was printed as if the comic itself had been put through a shredder. I had to cut it out of the paper and reassemble it in order to read it. I don’t remember there being too much fuss about it at the time. Why now?
    More to the point, what can we do to help?

      I was really late for my deadline, so I photocopied the MJ strip, cut it up and glued it to a piece of bristol board. It didn’t cause a fuss because to view it the reader had to cut and assemble it, making him guilty of baby porn manufacture.

    @Jon Will Balsley: The First Amendment gives you the right to make strips like that, but doesn’t force your hosting provider to keep your website up if you do. The hosting provider is a private company and if you violate its terms of service you get the boot.

    I’m not saying I agree with it in this case; I don’t think the site SHOULD be taken down over the strip — but people seem to misunderstand what free speech actually entails. Just because you have the right to say something doesn’t mean a hosting provider/book publisher/radio station is obligated to give you a forum to do it in.

    I have pecked around the “obscenity” laws governing distributed art- there is the recent case of a certain porn publisher/actor who was found guilty and is serving time for videos of consenting adults…damn bible-humping conservatives…

  15. Sorry to hear about your troubles with your webhost, Tony. I highly recommend checking out Dreamhost… they are cheap, you can install wordpress very easily, and they pretty much will let you host whatever legal content you want. I’ve been hosting loads of highly offensive Cartoonist Conspiracy jams there for years with no issues. They also have the best customer service I have ever run across from any company ever. Good luck resolving your problem, and thanks for all the wonderful comics.

    Anything I can do to help, let me know. Nobody raises a peep whenever the tabloids choose to feature Jon-Benet Ramsey’s near-naked corpse on the cover, there on view for all the mom’s and tots..but we artists sure are on a short leash. I was involved in a tabloid scandal in Kreutzberg, of all places, over our art show. Went on for a week. We got bomb threats. It was great.

    The First Amendment, laws regarding parody and satire, and the general common law position that it isn’t possible to libel/slander the dead, should offer some substantial protection here.

    Try the Electronic Freedom Foundation or the ACLU for assistance.

    Have they actually filed a claim, or is this just a cease and desist letter? (At $500-$1,000 a pop, those could be a pretty profitable enterprise for the lawyers for the Jackson family.)

    If this is true, I would think you could work with whoever’s doing this and agree to either take it this strip down, or simply block out some of the names and words and leave it up. There is no reason they should have the right to shut the whole site down. A lawyer can probably handle it with a simple letter.
